The authorities\u2019 policy in recent years has been to automatically reject Ukrainian asylum seekers in Israel, thus assistance may be needed by an attorney specializing in visas and entrance to Israel.<\/strong><\/p>\n<p dir=\"ltr\">Our law offices specialize in immigration law and entrance to Israel. If bringing in <a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/en\/ukrainians-to-israel\/\" target=\"_blank\" rel=\"noopener\">Ukranian friends<\/a>, relatives, or <a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/en\/status-for-asylum-seeker-spouse\/\">a spouse<\/a>, or if the asylum application of one of these has been refused, we will be happy to help you find refuge in the state of Israel during the current crisis.<\/p>\n<p dir=\"ltr\"><iframe title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/28nb_y94Lsk\" width=\"1744\" height=\"655\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<h4 dir=\"ltr\"><strong>Why have the immigration authorities refused Ukrainians\u2019 asylum applications in the past?<\/strong><\/h4>\n<p dir=\"ltr\">After 2014, when Russia annexed the Crimean Peninsula and a civil war broke out in Ukraine, <a href=\"https:\/\/www.globes.co.il\/news\/article.aspx?did=1001197809\">tens of thousands of asylum seekers<\/a> began coming to Israel \u2013 some from the war-torn eastern part of Ukraine, and some from other places. Israel is a developed nation with a high standard of living, home to many Russian and Ukrainian speakers. In addition to these obvious advantages, Israel is particularly accessible to CIS citizens (and former CIS countries such as Ukraine and Georgia) who do not need to obtain a tourist visa in advance in order to come to the Holy Land. Many of those who arrived on a tourist visa began to pass illegally even without submitting an application for asylum.<\/p>\n<p dir=\"ltr\">After a panic over \u201cinfiltrators\u201d in the middle of the preceding decade, the immigration authorities <a href=\"https:\/\/www.gov.il\/BlobFolder\/news\/ukraine_fast_service_for_asylum_requests\/en\/ukraine_fast_service_for_asylum_requests.pdf\">announced<\/a> an <a href=\"https:\/\/www.haaretz.co.il\/news\/education\/.premium-1.4515463\">expedited refusal<\/a> of any Ukrainian, Georgian, or Russian asylum seeker who could not bring proof that they were personally being persecuted due to religion, race, nationality, political affiliation or sexual preference.<\/p>\n<p dir=\"ltr\">Every asylum application based on a civil war in the country of origin, or even fighting in the area where the asylum applicant lives, was rejected as an \u201cidle claim\u201d of someone with economic motives, since the applicant theoretically had the option to move to another part of Ukraine, without personally suffering persecution and without needing to seek asylum in another country.<img decoding=\"async\" class=\"aligncenter wp-image-77300 size-medium\" src=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2022\/02\/aerial-top-view-kiev-motherland-statue-monument-hills-from-cityscape-kyiv-city-ukraine-300x168.jpg\" alt=\"Ukrainian asylum seekers in Israel\" width=\"300\" height=\"168\" srcset=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2022\/02\/aerial-top-view-kiev-motherland-statue-monument-hills-from-cityscape-kyiv-city-ukraine-300x168.jpg 300w, https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2022\/02\/aerial-top-view-kiev-motherland-statue-monument-hills-from-cityscape-kyiv-city-ukraine-1024x575.jpg 1024w, https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2022\/02\/aerial-top-view-kiev-motherland-statue-monument-hills-from-cityscape-kyiv-city-ukraine-768x431.jpg 768w, https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2022\/02\/aerial-top-view-kiev-motherland-statue-monument-hills-from-cityscape-kyiv-city-ukraine-1536x863.jpg 1536w, https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/wp-content\/uploads\/2022\/02\/aerial-top-view-kiev-motherland-statue-monument-hills-from-cityscape-kyiv-city-ukraine-2048x1150.jpg 2048w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/p>\n<h4 dir=\"ltr\"><strong>What changed in 2022?<\/strong><\/h4>\n<p dir=\"ltr\">After Putin announced his recognition of Ukraine\u2019s separatist regions, Donetsk and Lugansk, as independent states and\/or the annexation of these strips to the CIS, the Russian army invaded Ukraine. At the time of writing (late February 2022), the Russian forces are aiming to control Ukrainian territory, including the capital, Kiev, and are bombing military and civilian targets throughout the country. In this situation, it is impossible to claim that someone whose home is located in one of the areas of fighting can find safety for himself and his family within Ukrainian borders. This is the reason that the countries to the west of Ukraine have currently opened their gates to the refugees fleeing the threat of the Russian troops.<\/p>\n<p dir=\"ltr\">This is also the reason why Ukrainians currently in Israel or coming to Israel who are applying for asylum must be handled according to the current law and regulations, and not according to the abbreviated process. Moreover, at this point, refusing entrance to Ukrainian asylum seekers at Ben Gurion Airport or any other entrance point to Israel* is patently neither legal nor moral \u2013 return to their country of origin constitutes life-threatening danger, and their application must be examined in detail by the authorities authorized to do so.<\/p>\n<p dir=\"ltr\">At this point the Population and Immigration Authority has not yet clarified the issue of obtaining asylum in Israel, but has already <a href=\"https:\/\/www.gov.il\/he\/departments\/news\/ukr_2702\">declared a non-expulsion policy<\/a> for <a href=\"https:\/\/twitter.com\/Ayelet__Shaked\/status\/1497970896128122887?cxt=HHwWjoC5uf2l7skpAAAA\">tourists whose visa has expired<\/a> or for illegal residents from Ukraine. In addition, at this stage <a href=\"https:\/\/www.gov.il\/he\/departments\/news\/zrim_uk_2802\">funds are not being deducted<\/a> from the deposits of Ukrainian foreign workers and asylum seekers who are not leaving Israel even though their visas have expired.<\/p>\n<p dir=\"ltr\">*As long as a direct flight from Ukraine to Israel will be possible in the future or if the asylum seekers arrive in Israel via another country, something that does not violate international law.<\/p>\n<h4 dir=\"ltr\"><strong>What will happen after an asylum application is submitted?<\/strong><\/h4>\n<p dir=\"ltr\">The above linked articles by our office provide detailed explanations of the technical process of applying for asylum in Israel. Here we summarize the most important points:<\/p>\n<p dir=\"ltr\"><a href=\"https:\/\/www.unhcr.org\/il\/protection\/refugee-status-determination-rsd\">Almost no one<\/a>, <a href=\"https:\/\/fs.knesset.gov.il\/globaldocs\/MMM\/94be8d55-f7f7-e411-80c8-00155d010977\/2_94be8d55-f7f7-e411-80c8-00155d010977_11_8768.pdf\">whether or not he is eligible for refugee status under the law<\/a>, <a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/%D7%94%D7%9B%D7%A8%D7%94-%D7%91%D7%9E%D7%91%D7%A7%D7%A9-%D7%9E%D7%A7%D7%9C%D7%98-%D7%A4%D7%9C%D7%99%D7%98-%D7%95%D7%91%D7%A7%D7%A9%D7%95%D7%AA-%D7%9C%D7%9E%D7%A2%D7%9E%D7%93-%D7%A4%D7%9C%D7%99%D7%98\/\">receives official refugee status in Israel.<\/a> Refugee status is a type of temporary residency, and one of its important advantages is the ability to leave Israel for another country and then return. Virtually all of the asylum seekers in Israel whose applications are not immediately rejected have \u201ca <a href=\"https:\/\/www.gov.il\/BlobFolder\/policy\/haasakat_ovdim_zarim\/he\/temp_permit.png\">temporary permit<\/a> for a visit under Section (5)(A)2 of the Entrance to Israel Law,\u201d or, in slightly less bureaucratic terms, \u201casylum seekers\u201d. If the holder of such a permit leaves Israel for any reason, their 5A2 visa is cancelled, and they (and their family members) face an automatic entrance refusal in the future.<\/p>\n<p dir=\"ltr\">For this reason it is important to make sure, before applying for asylum, that the applicant does not have an urgent need to make arrangements in or visit the country of origin. Family members\u2019 visits between the two countries will be complicated or impossible during the asylum seeker\u2019s stay in Israel.<\/p>\n<h4 dir=\"ltr\">What about those whose entry to Israel is denied?<\/h4>\n<p dir=\"ltr\">Interior Ministry policy regarding the admission of Ukrainians varies daily. Since border inspectors have grown accustomed to refusing entry into Israel to anyone suspected of intending to apply for asylum, it is easy to return to these habits if there is no specific provision to allow the entry of Ukrainian refugees.<\/p>\n<p dir=\"ltr\">The courts <a href=\"https:\/\/megafon-news.co.il\/asys\/archives\/345425\">have banned the border control<\/a> from deporting those who are refused entry within 48 hours of their arrival, until they had a chance to speak with a lawyer and appeal against the refusal of entry. The asylum seeker must be notified of this right in Russian and Ukrainian.<\/p>\n<h4 dir=\"ltr\"><strong>Can an asylum seeker work in Israel?<\/strong><\/h4>\n<p dir=\"ltr\">Even though the 5A2 visa received by most asylum seekers will read \u201cThis temporary permit does not constitute a work permit,\u201d the state has promised in the past not to persecute asylum seekers working in Israel, or their employers. Therefore, one could say that asylum seekers can work in Israel legally, and they have the same rights as any employee in Israel, except that a portion of their salary is deposited in an <a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/en\/asylum-seeker-deposit\/\">asylum seekers\u2019 deposit<\/a>. For more information, see <a href=\"https:\/\/script_transfer_new.mowfns.ap-southeast-2.wpstaqhosting.com\/%d7%94%d7%a2%d7%a1%d7%a7%d7%aa-%d7%9e%d7%91%d7%a7%d7%a9%d7%99-%d7%9e%d7%a7%d7%9c%d7%98-%d7%91%d7%90%d7%95%d7%a4%d7%9f-%d7%97%d7%95%d7%a7%d7%99\/\">our article on this issue<\/a>.<\/p>\n<h4 dir=\"ltr\"><strong>How long is an asylum seeker\u2019s visa valid for?<\/strong><\/h4>\n<p dir=\"ltr\">An asylum seeker\u2019s visa does not have a legally determined length for understandable reasons \u2013 it can be extended for as long as return to the country of origin poses danger to the asylum seeker\u2019s life, health, or ability to remain free. Therefore, for Ukrainians, the amount of time for which someone will need to stay in Israel depends entirely on the actions of the Russian army. If indeed Russia is attempting to take over the entire country of Ukraine, there may be a war that lasts years, until the Russian regime collapses.
